Job Poaching

Meaning & Definition

Job poaching is the process of recruiting employees from other organizations, mainly on account of their skills, experience, or expertise. It is generally seen in highly competitive business environments wherein companies recruit talented individuals, offering them better compensation packages and career development. Employee poaching in HRM is also referred to as talent poaching.

Importance of Job Poaching

  • Benefits organizations in rapidly hiring competent personnel.
  • Reduces the training period as employees come with industry experience.
  • Increases competition for acquiring talented individuals in the market.
  • Promotes employers to adopt good strategies for employee retention.
  • Affects workforce planning, remuneration policy, and corporate image.

Legal Considerations

No direct statutory obligation can be associated with this terminology. However, the poaching of jobs could imply some employment-specific issues in India as follows:

  • There might be some confidentiality agreements that would continue post-resignation
  • Some Indian courts recognise reasonable employment restrictive clauses only when someone is actively employed
  • Unethical hiring practices that could involve trade secrets or confidential information must be avoided by companies
  • There may be HR policies regarding notice period, employee retention, and the company’s code of conduct
