Quid pro quo harassment
Meaning & Definition
Quid pro quo harassment exists when job benefits or job offers are conditioned upon an employee’s submission to unwelcome sexual advances. It includes the insistence on sexual favors in return for employment, promotion, favorable treatment, continued employment, or other job benefits. Threats or the imposition of disadvantages are often part of the quid pro quo demand.
Important Aspects of Quid pro quo harassment
- Ensures that workers are not subjected to a reduction in the standards under which work has to be carried out.
- May include hiring, fostering, placement, remuneration, advancement, assignment, or retention.
- May involve threats, pressure, requests, or promises related to activity the employee would rather avoid.
- May have a negative impact on employee dignity, safety, morale, and confidence in the workplace.
- Employers should have clear procedures in place for reporting and handling complaints.
- Workplace office training and preventative policies can make it easier for employees and managers to identify inappropriate behaviour.
Applicable Rules & Regulations
In India, quid pro quo sexual harassment may fall under the POSH Act, 2013 when the conduct meets the Act’s definition of sexual harassment. Covered employers must maintain an Internal Committee, follow prescribed complaint procedures, protect confidentiality, and provide appropriate awareness and training. Organizations should also maintain a clear anti-sexual-harassment policy and comply with applicable legal requirements.
