Reasonable Person Standard
The Reasonable Person Standard is a legal term used to determine how a typical, rational individual would behave in a given scenario. It can be used in HR to help assess the overall conduct of the workplace and can be helpful when considering employer actions, harassment issues, safety matters, and more.
Important Features of the Reasonable Person Standard
- Helps in judging the workplace behaviour of any professional.
- Promotes impartial and uniform assessment of employee behavior.
- Rationale for interpreting a workplace harassment or misconduct complaint.
- Provides HR teams with a tool to evaluate whether the actions and decisions made by the employer are reasonable.
- Promotes appropriate behaviour and policies.
- Helps ensure that objective decisions are made during workplace investigations and conflict resolution.
Legal Considerations
- Use the standard objectively and take into account the facts, circumstances, and legal requirements that relate to it.
- For harassment cases that arise at work, depend on the mandatory legal test set out in the law, rather than a generic reasonable person approach.
- Record investigations and decisions correctly, and maintain confidentiality.
In India, the test varies according to the situation. A complaint arising out of sexual harassment at the workplace comes under the POSH Act, 2013, which lays down the definition of sexual harassment at the workplace and procedures to be followed.
