Legal Considerations

There is no single law in India that mandates “new-hire reporting” as follows in some countries.

However, employers must complete applicable statutory registrations and maintain employee records under relevant laws, including:

  • Employees’ Provident Funds and Miscellaneous Provisions Act, 1952 (EPF): Registration of eligible employees for EPF.
  • Employees’ State Insurance Act, 1948 (ESI): Registration of eligible employees under the ESI scheme.
  • Income Tax Act, 1961: Collection of PAN and other required details for Tax Deducted at Source (TDS) compliance, where applicable.
