Legal Considerations
In India, non-compete agreements are governed by the Indian Contract Act, 1872. Under Section 27 of the Act, agreements that prevent a person from practicing a lawful profession, trade, or business are generally invalid, except in limited circumstances recognized by law.
However, reasonable restrictions during the course of employment are generally enforceable, while post-employment non-compete clauses are generally not enforceable unless they fall within recognized legal exceptions.
