Notice Period Buyout

Meaning & Definition

Notice Period Buyout is an arrangement where an employee or employer compensates the other party instead of serving the full notice period mentioned in the employment contract. It allows the employment to end earlier by paying an amount equivalent to the unserved notice period, subject to the company’s employment policy and mutual agreement.

There is no specific law in India that mandates a notice period buyout. It is governed by the employment contract, appointment letter, company HR policy, and the applicable provisions of the Industrial Disputes Act, 1947 (or the corresponding provisions under the Industrial Relations Code, 2020, when notified and applicable). Any buyout terms should comply with the agreed employment conditions and applicable labour laws.
