Disciplinary Action

Meaning & Definition

Discipline Action represents a corrective action taken against an employee who has violated organizational rules and policies and expected behaviours within the work environment. These actions are meant to correct the employee’s inappropriate behaviour, maintain order within the workplace and treat the employee fairly and in accordance with the due process established by the organization.

Important Features of Disciplinary Action

  • Maintain workplace order and discipline.
  • Consistently handle employee violations.
  • Protect the organization from potential litigation and compliance issues.
  • Encourage employee compliance with established policies and procedures.
  • Promote fair and just people management processes.

Legal & Regulatory Considerations

The disciplinary laws in India are governed by the Industrial Employment Act, 1946, the Industrial Disputes Act, 1947, and principles of natural justice. Employers must conduct a proper investigation, maintain records of the investigation process and give employees the opportunity to present themselves or any evidence before making a decision.
